Warranty Cover

GIBS warrants the products listed below against manufacturing defects for 15 years from the date of installation. The products are also warranted on delivery to meet the applicable GIBS product specifications and the standards stated in the relevant GIBS technical literature.

Conditions

This warranty applies only where the product remains unaltered, has been correctly stored and handled, and has been installed by a suitably qualified tradesperson in accordance with GIBS installation instructions and technical information current at the date of installation.

Claims

A warranty claim must be submitted to the supplier from whom the product was purchased, together with proof of purchase and sufficient details and evidence of the fault and its extent. The supplier must forward the claim to GIBS. All expenses incurred in making a claim under this warranty are borne by the claimant.

Remedy and Liability

Where GIBS accepts a valid warranty claim, GIBS may, at its option, repair, rectify or replace the affected product. GIBS’ liability is limited to the replacement cost of the defective material, reduced proportionately according to the part of the 15-year warranty period that has expired.

The warranty applies only to the original building project and is limited to the GIBS product found to be defective.

To the extent permitted by law, GIBS gives no other express or implied warranty in relation to the product, including its fitness for a particular residential or commercial application other than its published recommended use. Subject to rights that cannot lawfully be excluded, GIBS will not be liable in contract, tort, negligence, strict liability, breach of statutory duty or otherwise beyond the obligations stated in this warranty.

Exclusions

• damage to other products used with a GIBS product, or damage resulting from the installation of those products;
• claims relating to another manufacturer’s product;
• damage arising from recommendations made by a GIBS representative concerning other products, materials or combinations of products;
• damage caused by the installation or assembly of the GIBS product;
• incorrect installation or incompatibility with other materials or products;
• use of the product for applications or purposes outside its intended or published recommended use, including uses outside the building and construction industry;
• damage caused by aggressive chemicals, incompatible metals, immersion in water, chemically treated or green timber, storm, tempest or other events beyond GIBS’ control; or
• normal fair wear and tear.

The buyer is responsible for determining the suitability and compatibility of other products, materials, or the environment of the installation site used with GIBS products and should obtain independent advice where appropriate.

Transfer and Change of Use

This warranty applies only to the original project and application and is not transferable. A change in building ownership or in the purpose or use of the building will cancel this warranty unless GIBS is notified beforehand and confirms that the warranty remains valid for the proposed use.

Australian Consumer Law

This warranty is provided in addition to other rights and remedies available under law.

Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.
